1. Terms & Condition of Use

You, as a registered or guest user who meets the eligibility conditions set out herein (“User”), agree to be bound by the terms by using the Website. Please read them carefully since by continuing to use the Website, you agree to be bound by these terms. You must not subscribe to or use the Website or our services if you do not agree to be bound by the terms.

1.2  You accept and agree to be bound by Mamar Dokan Policies (including but not limited to the Privacy Policy found at (https://mamardokan.com/t/privacypolicy) as revised from time to time by implicitly or expressly accepting these Terms.

1.3 The end user/customer using the Website, its contents, and using the Services supplied through the Website is referred to as “you” in these Terms. The terms “Website,” “Mamar Dokan,” “mamardokan.com,” “mamardokan.com.bd,” “we,” “us,” electronic record in terms of Information & Communication Technology Act, 2011 (তথ্য ও যোগাযোগ প্রযুক্তি আইন, ২০১১) and rules there under as applicable and as amended from time to time.

1.4  Need to be remembered this document does not require any physical or digital signatures and forms a valid and binding agreement between the Website and the User.

1.5 The Website is owned and run by Mamar Dokan, a Bangladeshi ecommerce business with its registered office at Poyalgacha, Poyalgacha-3561, Barura, Cumilla, Bangladesh. In inclusion of the online portal, any references to the Website in these Terms shall be deemed to refer to the aforementioned organization.

1.6 This Website may also contain links to other websites that are not managed by Mamar Dokan. Mamar Dokan has no control over the linked sites and assumes no responsibility for them or any loss or damage that may occur as a result of your use of them. The terms of use and service found within each linked site will govern your use of that site.

1.7 At any time, we retain the right to modify these Terms. When the updates are uploaded on the website, they become effective. You accept the Terms as updated if you continue to use the Website after we post any such changes.

2.  Eligibility

2.1 Use of the Website is available only to such persons who can legally contract under the Contract Act, 1872.

2.2 If you are under the age of 18, you must not register as a user of mamardokan.com or mamardokan.com.bd and you must not transact on or use the Website. If you are a minor and wish to use or transact on the website, your legal guardian or parents may do so on your behalf. If it is brought to Mamar Dokan’s attention or it is discovered that you are under the age of 18, Mamar Dokan retains the right to terminate your membership and/or refuse to provide you with access to the website.

2.3 Accepting the Terms or using or transacting on the Website constitutes an irrevocable declaration and undertaking by the User that he or she is of legal age, i.e. 18 years or older, and capable of entering into a binding contract, and such usage shall be deemed to form a contract between the Website and such User to the extent permissible under applicable laws.

2.4 The usage of the services offered through the Website is only available if the address of the user to which the product(s) is/are to be delivered is within Bangladesh; Mamar Dokan is serving within 1 hour Express Delivery Service to Cumilla, Bangladesh. For the Regular Delivery, Mamar Dokan is currently delivering within 3 to 5 working days timeframe.  Subject to the above, if the user specifies a convenient time and Mamar Dokan will send the products during that time.

3.  Communication 

3.1 You consent to receive messages from us while you use mamardokan.com or mamardokan.com.bd or contact us by phone or email. You give us permission to communicate with you via e-mail, SMS, phone call, posting notices on the website, or any other means. You consent to receive communications (including transactional, promotional, and/or commercial messages) from us regarding your use of the website and/or your order placed in the website for contractual purposes. Furthermore, any disclosures made on the site or conveyed to you through email satisfy the legal requirement of written communication.

4. Your Account and Responsibilities 

4.1 Anyone can use the Website either by registering for an account or by visiting it as a guest. 9.  The Contract

9.2 You can cancel your order for a product at no cost any time before the goods are delivered to you.

10.  Product Descriptions 

10.1 Mamar Dokan makes every effort to be as precise as possible. Mamar Dokan does not create or manufacture any of its own products. As a result, Mamar Dokan makes no representations or warranties about the accuracy, completeness, reliability, correctness, or error-free nature of any Mamar Dokan product description or other information. If a product sold by Mamar Dokan does not meet your expectations, your only option is to return it in unused condition and immediately notify to us.

11.  Pricing

11.2 Despite our best efforts, there is a chance that some of the items in our catalogue are incorrectly priced. If the MRP of an item sold by Mamar Dokan is greater than our advertised price, we will contact you for instructions before delivery or cancel your order and alert you. And, if the product’s advertised price is lower than Mamar Dokan, we’ll either refund the difference or replace the item, depending on your desire, once we’ve received confirmation.

12. Return Policy (in case of following situations)

i. If product does not meet the user’s expectations.

ii. Found damaged during delivery.

iii. Have doubt about the product quality and quantity.

iv. Received in an unhealthy/ unexpected condition

12.1 A user may return any product during the time of delivery, or within 7 days if anything happened as mentioned earlier. Mamar Dokan will monitor continuously and closely and will take necessary steps to prevent this.
